ผู้อยู่อาศัย เจ้าของที่ดิน และผู้ประกอบธุรกิจในพื้นที่บางเทา จังหวัดภูเก็ต ได้ออกจดหมายเปิดผนึกถึงผู้ว่าราชการจังหวัดภูเก็ตคนใหม่ นายโชตินรินทร์ เกิดสม เพื่อเรียกร้องให้มีการปิดสถานประกอบการริมชายหาดจำนวน 16 แห่งอย่างถาวร ซึ่งรวมถึง Maya Beach Club และ Yuuhi Beach Club โดยอ้างถึงปัญหามลพิษทางเสียงอย่างรุนแรง และการบุกรุกที่ดินของรัฐโดยมิชอบด้วยกฎหมาย คำร้องดังกล่าวเรียกร้องให้คงมาตรการปิดสถานประกอบการในปัจจุบันไว้ พร้อมทั้งขอให้มีการบังคับใช้กฎหมายอย่างเข้มงวดยิ่งขึ้น เพื่อปกป้องพื้นที่อยู่อาศัยจากการรบกวนของกิจกรรมปาร์ตี้ยามค่ำคืนที่เกิดขึ้นซ้ำอย่างต่อเนื่อง

พวกเรา ผู้ลงนามด้านล่าง ซึ่งเป็นผู้อยู่อาศัยและผู้มีส่วนได้เสียในพื้นที่ท้องถิ่น หมู่ 2 ตำบลเชิงทะเล (พื้นที่ชายหาดบางเทา) ขอเขียนจดหมายฉบับนี้เพื่อแสดงความขอบคุณอย่างสูง และขอชื่นชมเป็นอย่างยิ่งต่อการดำเนินการตรวจสอบล่าสุดของกองอำนวยการรักษาความมั่นคงภายในภาค 4 (กอ.รมน.ภาค 4) ต่อสถานประกอบการริมชายหาดจำนวน 16 แห่ง ที่มีการกระทำอันฝ่าฝืนพระราชบัญญัติป่าไม้ ทั้งนี้ พวกเราขอเรียกร้องอย่างเร่งด่วนให้รัฐบาลจังหวัดขยายมาตรการบังคับใช้กฎหมาย เพื่อแก้ไขปัญหาการฝ่าฝืนข้อกำหนดด้านการใช้พื้นที่เพื่อการประกอบกิจการบันเทิงอย่างรุนแรงและเกิดขึ้นเป็นประจำทุกวัน
ก่อนที่สถานประกอบการเหล่านี้ ซึ่งรวมถึง Maya Beach Club, Yuuhi Beach Club และสถานประกอบการอื่น ๆ จะถูกสั่งปิดอย่างถูกต้องตามกฎหมาย ชุมชนของพวกเราต้องเผชิญกับวิกฤตการณ์ร้ายแรงในชีวิตประจำวัน สถานประกอบการเหล่านี้เปิดเสียงดนตรีในระดับความดังสูงอย่างต่อเนื่อง และจัดกิจกรรมปาร์ตี้กลางแจ้งขนาดใหญ่ทุกคืนจนถึงเวลา 03.00 น. หรือ 04.00 น. สิ่งนี้ทำให้พื้นที่บางเทาไม่สามารถอยู่อาศัยได้ ทำลายการพักผ่อน สุขภาพ และคุณภาพชีวิตของครอบครัวในพื้นที่ รวมถึงทำให้นักท่องเที่ยวที่คาดหวังสภาพแวดล้อมที่สงบเงียบเดินทางออกจากพื้นที่
พวกเราเข้าใจดีว่าผู้ประกอบการเหล่านี้กำลังใช้แรงกดดันอย่างมหาศาลต่อหน่วยงานภาครัฐ เพื่อให้ได้รับอนุญาตให้กลับมาเปิดดำเนินการอีกครั้ง พวกเราจึงขอเขียนหนังสือฉบับนี้เพื่อร้องขออย่างเร่งด่วนให้สำนักงานของท่านดำเนินการให้แน่ใจว่า สถานประกอบการเหล่านี้จะไม่ได้รับอนุญาตให้กลับมาเปิดดำเนินการในรูปแบบเช่นที่ผ่านมา โดยมีประเด็นสำคัญดังต่อไปนี้:
1. การฝ่าฝืนข้อกำหนดด้านการใช้พื้นที่ที่ไม่สามารถยอมรับได้:
พื้นที่บางเทาเป็นพื้นที่อยู่อาศัยและแหล่งท่องเที่ยวที่มุ่งเน้นครอบครัวเป็นพื้นฐาน การอนุญาตให้สถานประกอบการเหล่านี้กลับมาเปิดดำเนินการ พร้อมจัดกิจกรรมปาร์ตี้จนถึงช่วงเช้าเวลา 03.00–04.00 น. ทุกวัน จะทำให้ปัญหามลพิษทางเสียงที่ไม่สามารถยอมรับได้กลับมาเกิดขึ้นอีกทันที ซึ่งเป็นการฝ่าฝืนกฎหมายด้านสาธารณสุขของประเทศไทย และทำลายการดำรงอยู่ทางเศรษฐกิจของโรงแรมบูทีคและวิลล่าโดยรอบที่ประกอบกิจการอย่างถูกต้องตามกฎหมาย
2. การใช้ประโยชน์จากพื้นที่สาธารณะและพื้นที่คุ้มครองโดยมิชอบ:
ธุรกิจเหล่านี้ไม่ได้เพียงแต่สร้างความรบกวนต่อความสงบเรียบร้อยเท่านั้น แต่ยังดำเนินกิจการโดยมีการครอบครองพื้นที่ที่เป็นข้อพิพาทและมีการบุกรุกพื้นที่ของรัฐอย่างชัดเจน พื้นที่ชายหาดที่ได้รับการคุ้มครองควรเปิดให้ประชาชนสามารถใช้ประโยชน์ได้ ไม่ควรถูกเปลี่ยนเป็นพื้นที่สถานบันเทิงยามค่ำคืนเชิงพาณิชย์ที่ไร้ระเบียบ ดำเนินกิจการโดยไม่มีใบอนุญาตที่ถูกต้อง
3. การป้องกันปัญหาการรบกวนในอนาคต:
ความสงบชั่วคราวที่ชุมชนของเรากำลังได้รับในขณะนี้ จะต้องกลายเป็นความสงบที่ถาวร
ในขณะที่ฝ่ายบริหารชุดใหม่กำลังเสริมสร้างความเป็นระเบียบเรียบร้อยของสังคมและหลักนิติธรรมบนเกาะภูเก็ต พวกเราขอเรียกร้องอย่างเร่งด่วนให้สำนักงานของท่านดำเนินการดังต่อไปนี้:
• คงมาตรการปิดสถานประกอบการไว้จนกว่าจะมีข้อผูกพันที่มีผลผูกพันทางกฎหมาย เพื่อรับรองว่าจะมีการปฏิบัติตามกฎหมาย: ปฏิเสธคำร้องขอเปิดดำเนินการสถานประกอบการเหล่านี้ จนกว่ากระบวนการทางกฎหมายเกี่ยวกับการบุกรุกที่ดินของรัฐโดย กอ.รมน. จะได้รับการแก้ไขจนเสร็จสิ้นโดยสมบูรณ์
• บังคับใช้เงื่อนไขที่เข้มงวดในอนาคต: หากสถานประกอบการใดในเขตพื้นที่อยู่อาศัยแห่งนี้ได้รับอนุญาตให้ดำเนินกิจการในอนาคต จะต้องอยู่ภายใต้ข้อกำหนดที่เข้มงวดและมีผลผูกพันตามกฎหมาย โดยกำหนดให้การใช้เครื่องเสียงขยายเสียงทั้งหมดต้องยุติลงโดยสมบูรณ์ตามเวลาที่กำหนดไว้ในข้อกำหนดการใช้พื้นที่ท้องถิ่น
• ปกป้องลักษณะพื้นที่อยู่อาศัยของบางเทา: ป้องกันไม่ให้พื้นที่ท่องเที่ยวสำหรับครอบครัวที่สงบสุขแห่งนี้ถูกเปลี่ยนเป็นพื้นที่ปาร์ตี้ยามค่ำคืนที่ปราศจากการควบคุม

ในอดีตที่ผ่านมา หลายครั้งพวกเราได้เห็นการปิดชั่วคราว ตามมาด้วย “การเปิดให้บริการครั้งใหญ่” ซึ่งทุกฝ่ายกลับไปเพิกเฉยต่อกฎหมายและดำเนินการตามที่ต้องการทันที วงจรเช่นนี้จะต้องยุติลงตั้งแต่บัดนี้ หวังเป็นอย่างยิ่งว่าท่านจะนำมาซึ่งการเปลี่ยนแปลงในทางที่ดี!
พวกเราเชื่อมั่นในความเป็นผู้นำที่เข้มแข็งและเด็ดขาดของท่าน ในการปกป้องที่ดินสาธารณะ รักษาความสงบสุขของประชาชนชาวภูเก็ต และป้องกันไม่ให้การดำเนินกิจการที่สร้างความเดือดร้อนเหล่านี้กลับมาเกิดขึ้นอีก

Today, we the residents, landowners and business in Bang Tao, Phuket, have issued an open letter to new Governor Chotinarin Kerdsom urging the permanent closure of 16 beachfront venues, including Maya Beach Club and Yuuhi Beach Club, citing severe noise pollution and illegal encroachment on public land. The petition calls for maintaining the current shutdown while demanding stricter enforcement to protect the residential area from recurring, late-night party disruptions.
Subject: Urgent Petition Regarding Prevention of Noise Pollution and Permanent Closure of Encroaching Beach Clubs in Bang Tao Residential Area
Dear Governor Chotinarin Kerdsom and Rear Admiral Praphan Srisuvipa,
We, the undersigned residents and local property stakeholders of Moo 2, Cherng Talay (Bang Tao Beach area), are writing to express our profound gratitude and we highly applaud the recent ISOC Region 4 investigation into the 16 beachfront venues violating the Forest Act, we urgently request that the provincial government expand its enforcement to address severe, daily entertainment zoning violations.
Until these venues—including Maya Beach Club, Yuuhi Beach Club, and others—were rightfully shut down, our community was facing a severe, daily crisis. These establishments routinely blasted high-decibel music and threw massive outdoor parties every single night until 03:00 AM or 04:00 AM. This made Bang Tao entirely unlivable, destroyed the sleep and health of local families, and drove away tourists who expect a peaceful environment.
We understand that these operators are currently putting immense pressure on authorities to allow them to reopen. We are writing to urgently request that your offices ensure they are not permitted to resume operations in the manner they have in the past, based on the following critical points:
- Unacceptable Zoning Violations: Bang Tao is fundamentally a residential and family-oriented tourism area. Letting these clubs reopen with parties until early morning 03-04am every day, would immediately bring back the intolerable noise pollution that violates Thai public health laws and ruins the economic livelihood of surrounding law-abiding boutique hotels and villas.
- Exploitation of Public and Protected Space: These businesses did not just disturb the peace; they did so while explicitly occupying contested and encroached state land. Protected beachfront should remain open to the public, not turned into lawless, commercial nightlife zones that operate without valid permits.
- Prevention of Future Disruptions: The temporary peace our neighborhood is experiencing right now must become permanent.
As the new administration reinforces public order and the rule of law on the island, we urgently request that your offices:
- Maintain the shutdown until binding commitments are in place to ensure that they will comply with law: Deny any requests to reopen these structures until the ISOC land-encroachment legal proceedings are completely resolved.
- Enforce Strict Future Conditions: If any venue in this residential zone is ever permitted to operate in the future, it must be under a strict, legally binding mandate that all amplified music ceases completely by standard local zoning hours.
- Protect the Residential Character of Bang Tao: Prevent the conversion of this peaceful family destination into an unregulated, late-night party zone.
Ultimately, this issue is not about commercial profit; it is about protecting the future of our Phuket. While these venues are only interested in generating big profits, we are interested in obeying the laws. We urge and request every business and citizen to operate strictly under the law, and we ask for permanent, ongoing oversight to ensure this is never forgotten.
Too many times in the past, we have witnessed temporary closures followed by a “grand reopening,” where everyone immediately went back to ignoring all laws and doing whatever they wanted. This cycle must end now. Hopefully you bring positive change!
We trust in your strong, decisive leadership to protect public land, safeguard the peace of Phuket’s residents, and prevent these disruptive operations from returning.
